Barrack, Rodos & Bacine Named as Interim Class Counsel in COVID-Related Business Interruption Insurance Cases Against Cincinnati Insurance Company

12/22/2020 - Barrack, Rodos & Bacine has brought a number of class action lawsuits against several insurance companies that have uniformly denied the claims of businesses forced to either shut down entirely or offer limited service as a result of government orders relating to the COVID-19 pandemic. The complaints in those cases allege that the companies’ denial of the claims was improper and that the claims under the policies’ business interruption and related coverages should have been honored. Two of those class action cases were filed in the United States District Court for the Eastern District of Pennsylvania against Cincinnati Insurance Company and a subsidiary. Over the objection of the Cincinnati companies, the court issued an opinion and order on December 22, 2020, consolidating those cases and appointing Barrack, Rodos & Bacine as interim class counsel.

There are dozens of similar cases against Cincinnati Insurance Company pending in state and federal courts around the country. As a result of proceedings before the Judicial Panel on Multidistrict Litigation, the cases are all proceeding in the courts where they were filed. The order appointing Barrack, Rodos & Bacine as interim class counsel in the Cincinnati Insurance Company cases in the Eastern District of Pennsylvania allows us to speak on behalf of the classes in the cases in this district and better positions us to coordinate activities with counsel for policyholder plaintiffs in other similar cases against Cincinnati Insurance Company around the country.
