Samuel M. Ward, a partner in BR&B’s San Diego office, joined the firm in 2003.

At BR&B, Mr. Ward has focused his practice on complex class action litigation, including both securities class actions and consumer class actions and has litigated numerous securities cases in federal district courts throughout the country.  Mr. Ward was a member of the trial team in In re Apollo Group Inc. Securities Litigation, before the Honorable James A. Teilborg in the District of Arizona, where he played a critical role in mastering the deposition and documentary proof that was used at trial to secure the jury’s unanimous verdict.  Mr. Ward also represented the plaintiff class in In re Applied Micro Circuits Corp. Securities Litigation, achieving a $60 million settlement for class members, one of the largest recoveries in a securities class action in the Southern District of California since passage of the PSLRA.  Mr. Ward has also represented plaintiffs in In re Hewlett-Packard Company Securities Litigation, Civil Action No. 8-11-cv-01404 (AG-RNB (C.D. Cal); In re Bridgestone Securities Litigation, Civil Action No. 3:01-cv-0017 (M.D. Tenn.), In re OmniVision Technologies, Inc., Securities Litigation, Civil Action No. 5:11-cv-05235-RMW (N.D. Cal.), In re Roadrunner Transportation Systems, Inc. Securities Litigation, Civil Action No. 17-cv-144-LA (E.D. Wis.), and In re WageWorks, Inc., Securities Litigation, Civil Action No. 4:18-cv-01523-JSW (N.D. Cal.), among others. 

In addition, Mr. Ward has litigated numerous consumer and insurance class actions on behalf of plaintiff classes.  Mr. Ward was co-counsel in a number of “Senior Annuities” cases successfully prosecuted by BR&B against insurance companies that were marketing long term annuities to senior citizens.  These “Senior Annuity” cases alleged violations of the Racketeering Influenced Corrupt Organization Act (RICO) and violations of state consumer laws, including Rand v. American National Life Insurance Company, Civil Action No. 3:09-cv-CV-09-0693 (N.D. Cal.); In re National Western Deferred Annuities Litigation, Civil Action No. 3:05-cv-01018 (S.D. Cal.); and Hansen v. Conseco Insurance Company, Civil Action No. 5:05-cv-04726 (N.D. Cal.).  Collectively, the “Senior Annuity” cases secured benefits for class members collectively valued in excess of $1 billion.

As a Special Assistant Attorney General on behalf of the Attorney General of New Mexico, Mr. Ward prosecuted a consumer fraud action against Vivint Solar, Inc., achieving a substantial settlement on behalf of the citizens of New Mexico.  In addition, Mr. Ward has served as counsel in actions against Google, Inc., RE Loans, Apple, Inc., Toyota Motor Sales, USA, Inc., Anthem, Inc., and others.

Before joining Barrack, Rodos & Bacine, Mr. Ward worked as a political consultant in San Diego, managing and advising several candidates for City Council, State Assembly, and United States Congress. He is a former Chair of Planned Parenthood Affiliates of California and a former Vice-Chair of the Board of Directors of Planned Parenthood of the Pacific Southwest. Mr. Ward currently serves on the Independent Oversight Committee of the Carlsbad Unified School District, where he oversees expenditures made pursuant to facilities bonds issued by the school district.
